These Terms of Service ("Terms") govern your access to and use of the website at aztheon.com and any software, mobile applications, products, and services provided by Aztheon, LLC ("Aztheon," "we," "us," or "our") (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

5. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, or error-free.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AZTHEON AND ITS MEMBERS, MANAGERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR THE APPLICABLE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

7. Indemnification

You agree to indemnify and hold harmless Aztheon and its members, managers, and affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Services or your violation of these Terms.

8. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or to protect the Services. Provisions that by their nature should survive termination will survive.

9. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in New York for any dispute arising out of these Terms or the Services, to the extent permitted by law.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
